Section 22A (15) Permits

The Council has received the following information from the Department of Health in response to a letter seeking clarity:

REQUEST FOR INFORMATION PERTAINING TO THE APPLICATION FOR PERMITS IN TERMS OF SECTION 22A (15) OF THE MEDICINES AND RELATED SUBSTANCES ACT, 1965 (ACT NO. 101 OF 1965) AS AMENDED
  
The application form for a Section 22A (15) permit has been amended to make provision for all types of services requiring a Section 22A (15) permit.  This form is available on the Department of Health web-site.
  
A nurse in possession of a Section 22A (15) concession may acquire, use and supply Schedule 1 and 2 medicines without a prescription.  This includes the administration of vaccines, fluids for irrigation and certain topical ointments.  Any Schedule 3 and higher medicines require a prescription issued by an authorised prescriber who may only dispense his/her own prescription if in possession of a dispensing licence.  Section 22A (3) states that "Any Schedule 0 substance may be sold in an open shop".  There is therefore no restriction on the purchase or sale of Schedule 0 substances.
